1. Agreement to Terms

By accessing or using the LendTrust platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Account Registration and Requirements

To use certain features of the platform, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

You must be at least 18 years old and legally able to enter into binding contracts to use our services.

3. Services Description

LendTrust provides a platform that connects borrowers and lenders for peer-to-peer lending. Our services include:

• Facilitating loan requests and offers
• Providing loan agreement templates
• Tracking loan repayments
• Calculating and displaying borrower reputation scores
• Offering tools for managing loan documentation

LendTrust is not a lender, does not provide loans directly, and does not guarantee that users will receive loans or that loans will be repaid.

4. Loan Terms and Conditions

All loans facilitated through our platform are direct agreements between borrowers and lenders. LendTrust is not a party to these agreements.

Users are responsible for ensuring that their loan terms comply with all applicable laws and regulations, including those related to interest rates, lending practices, and consumer protection.

Loan agreements generated through our platform are legally binding contracts between the borrower and lender.

5. Fees and Payments

LendTrust charges fees for certain services as outlined in our Pricing page. We reserve the right to change our fee structure with notice to users.

Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected.

All fees are non-refundable except as required by law or as explicitly stated in these Terms.

6. User Conduct and Restrictions

You agree not to use the platform to:

• Violate any laws or regulations
• Infringe on the rights of others
• Provide false or misleading information
• Engage in fraudulent activities
• Harass, threaten, or intimidate other users
• Attempt to gain unauthorized access to the platform
• Use the platform for any illegal purpose

7. Intellectual Property Rights

The platform and its original content, features, and functionality are owned by LendTrust and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

8. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LENDTRUST DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDTRUST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM
• ANY CONTENT OBTAINED FROM THE PLATFORM
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

10. Indemnification

You agree to defend, indemnify, and hold harmless LendTrust, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the platform or your violation of these Terms.

11. Termination

We may terminate or suspend your account and bar access to the platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the platform or contact us to request account deletion.

12. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the platform shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our platform after any revisions become effective, you agree to be bound by the revised terms.
